RESOLVE is pleased to announce that more Coloradans have access to the care they need to build their families now that the Colorado Building Families Act took effect on January 1, 2023. The new law applies to those who have large group insurance controlled by the state of Colorado, namely fully-insured employers with more than 100 employees.
Health plans that renewed in January 2023 (and plans that will renew later in 2023) must provide for three completed egg retrievals and unlimited embryo transfers, as well as fertility preservation for cancer patients and others at risk of medically-induced infertility. Coverage must be inclusive of the LGBTQ+ community and unpartnered individuals.
RESOLVE partnered with Colorado Fertility Advocates to pass this pro-family law, along with our national coalition partners, including the American Society for Reproductive Medicine and Alliance for Fertility Preservation.
If you’re unsure if your plan now covers fertility benefits, you should talk with your HR department about your plan options and also with the health insurance company behind the plan(s). Be sure to read the plan summaries thoroughly and ask questions before signing onto the plan.
If you’ve been told by your employer that they are not participating in this new law, please confirm that they are a self-insured employer (typically 500 or more employees) or have fewer than 100 employees, or their insurance is controlled by another state, perhaps where they have (other) headquarters.
